This End User License Agreement ("EULA") is the licence for the Holy Bucket app (the "App"). It is an agreement between you and Holy Bucket, the developer of the App ("we", "us"). By downloading or using the App you agree to this EULA. It applies alongside our Terms of Service and Privacy Policy.
This EULA is between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
Your licence to use the App
We grant you a personal, non-transferable, non-exclusive licence to use the App on any Apple-branded device that you own or control, as allowed by the Usage Rules in Apple’s App Store Terms of Service. You may not copy (except as that licence allows), redistribute, sublicense, rent, lend, sell, reverse-engineer, decompile, or modify the App, except where the law says you may.
Maintenance and support
We are solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support. You can reach us at hello@holybucket.app.
Warranty
The App is provided "as is". To the maximum extent permitted by law, we disclaim all warranties. If the App fails to conform to any warranty that cannot be disclaimed, you may notify Apple, and Apple will refund the purchase price of the App to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our sole responsibility.
Claims about the App
We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar law. This EULA does not limit our liability to you beyond what the law permits.
Intellectual property
If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of any such claim, to the extent required by this EULA.
Legal compliance
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party terms
You must comply with any applicable third-party terms when using the App. For example, the App reads your Google and, optionally, Bing data, and your use of those services remains subject to their own agreements.
Apple as third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of it, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
